Under Penal Code 243.4, sexual battery occurs when a person touches an intimate part of another person who is unlawfully restrained, against that person’s will, and for the purpose of sexual arousal, gratification, or abuse. By statute, “intimate part” includes a female breast or any part of the groin, anus, buttocks, or sexual organs. Bare-skin contact is generally required for felony sexual battery, while misdemeanor charges can involve touching through the clothing of either person.

Sexual battery is a wobbler offense, meaning the Orange County District Attorney’s office can file the case as either a misdemeanor or a felony. That charging decision isn’t automatic. It turns on the prosecutor’s read of the facts, the specific circumstances alleged, and the defendant’s background. Penalties for a Sexual Battery Conviction

When the accused was the victim’s employer, that fine ceiling rises to $3,000. Felony forms of the charge carry a fine of up to $10,000 and a state prison term of two, three, or four years.

Felony convictions under subdivisions (a), (c), or (d) of PC 243.4 require lifetime, Tier Three registration under California’s Sex Offender Registration Act.
